KSC announces an opportunity for your school or after school program to win a Naturalyards School Garden Kit!

HOW YOU CAN WIN

There are three ways to win a Naturalyards school garden kit for your school:

  • ONE. The teacher, parent and/or legal guardian that submits the most accepted entries to the Kids’ Science Challenge contest by January 15, 2012 wins.
  • TWO. The teacher, parent and/or legal guardian that submits the most accepted entries to the Kids’ Science Challenge contest by the February 29, 2012 contest submission deadline wins.
  • THREE. All teachers, parents and/or legal guardians who submit five or more accepted entries by the February 29, 2012 deadline will have their school’s name entered into a chance drawing, and one of those lucky schools, whose name will be selected at random, will win.

WHAT YOU CAN WIN
Each winner will receive a $3,500 gift certificate for their school to use towards a Naturalyards school garden kit. From planning to planting, Naturalyards will assist the winning schools in building the school gardens of their dreams. Naturalyards cedar kits are so easy to assemble that young children can participate!"

THE BASIC RULES

  1. All entrants to the School Garden Competition must be a teacher, parent, legal guardian, or teacher of an after-school program that is sponsoring children’s entry applications to the Kids’ Science Challenge.
  2. All children’s entries to the Kids’ Science Challenge must comply with the official Kids’ Science Challenge contest rules, which can be found here: http://www.kidsciencechallenge.com/year-four/about_rules.php.
  3. All entry packages must be sent by US Mail or by a courier service (e.g., FedEx, UPS, etc.).
  4. Multiple KSC entry submissions from the same entrant to the School Garden Competition will be combined.
  5. Only one prize will be awarded per winning entrant, school, or after school program.
  6. To win prize ONE, all entry packages must be postmarked by January 15, 2012.
  7. To win prizes TWO or THREE, all entry packages must be postmarked by February 29, 2012.
  8. Prizes will be awarded only to public, private or parochial educational institutions or organizations in the United States that have sufficient communal space at their facility to fit the garden awarded. No prizes will be awarded to individuals or may be installed at private residences.
  9. No substitutions.  Prizes awarded are not transferrable.

THE COMPLETE RULES

  1. School Garden Competition Description. The Kids’ Science Challenge School Garden Competition (the "School Garden Competition") is designed to encourage parents, teachers, and legal guardians of eligible U.S. school students ("Entrant(s)") to enter as many students into the Kids' Science Challenge competition in order to win a Naturalyards school garden. The Prizes will be awarded in accordance with these Official Rules.
  2. Sponsor. The School Garden Competition is sponsored by Jim Metzner Productions, Inc. ("JMP"), a New York corporation.
  3. Binding Agreement. In order to enter the School Garden Competition, you must agree to these Official Rules ("Rules"). The Rules consist of the terms and conditions on this page. This School Garden Competition is only open to teachers (including after-school program teachers), parents and/or legal guardians who are submitting entry applications to the Kids’ Science Challenge on behalf of minor students, in accordance with the official Kids’ Science Challenge Ruls (the “KSC Rules”), which can be found here: http://www.kidsciencechallenge.com/year-four/about_rules.php. As stated in those rules, each and every entry submitted to the KSC must include permission from the parent/guardian of the child entering the KSC. Because these Rules form a legally binding agreement with respect to this School Garden Competition, please read them carefully. If you do not agree to the Rules, you are not eligible to participate in the School Garden Competition or to win any of the prizes. You agree that submission of an entry in the School Garden Competition constitutes your agreement to these Rules.
  4. Eligibility. The School Garden Competition is open to teachers, parents and/or legal guardians of students enrolled in private or public elementary schools in the 50 United States and the District of Columbia, and U.S. territories (collectively, "U.S. School(s)"). You may enter the School Garden Competition more than once. Multiple entries from the same sponsor will be combined.
  5. Employees, interns, contractors, and official office-holders, as well as their immediate families, of Jim Metzner Productions, Inc., its affiliates, and any representatives or agencies of Jim Metzner Productions, Inc., or other persons professionally connected with the School Garden Competitions or Kids’ Science Challenge are not eligible to participate. This School Garden Competition is void where prohibited.
  6. School Garden Competition Period. The School Garden Competition begins on October 1, 2011. Period One ends on January 15, 2012. Period Two ends on February 29, 2012.
  7. Who Can Enter. Teachers from U.S. Schools, parents and/or legal guardians from students registered in U.S. Schools, and teachers from After School Programs affiliated with a US School are eligible to register and submit entries on behalf of eligible entrants in the Kids Science Challenge ("Authorized Registrants").
  8. How To Enter. To enter the School Garden Competition, the teacher, parent and/or legal guardian of children entering the challenge should send complete applications on behalf of eligible entrants by US Mail or courier service (Fed Ex,UPS, etc.) to the following address:

    Entries sent by means other than mail or courier service or by anyone other than Authorized Registrants will not be considered eligible entries. Submissions must be: (i) complete (as determined by Jim Metzner Productions, in its sole discretion); (ii) in English (unless otherwise specified); (iii) postmarked by January 15, 2012 for Prize ONE, and by February 29, 2012 for Prizes TWO and THREE, and (iv) received by January 31, 2012 for Prize ONE, and March 15, 2012 for Prize TWO and THREE. Any submission not meeting the aforementioned criteria will be disqualified. Jim Metzner Productions accepts no responsibility for submissions lost, delayed, damaged, defaced, or mislaid, howsoever caused.
  9. Conduct. By entering the School Garden Competition, you agree to comply with and be bound by the Rules, which will also be posted on the Kids’ Science Challenge Website. Failure to comply with these Rules may result in your disqualification from the School Garden Competition. You further agree to comply with and be bound by the decisions of Jim Metzner Productions, which are final and binding in all respects. Jim Metzner Productions reserves the right in its sole discretion to disqualify any Entrant it finds to be: (1) tampering or attempting to tamper with the entry process or the operation of the School Garden Competition; (2) violating the Rules; (3) violating the terms of service, conditions of use or general rules or guidelines of any Jim Metzner Productions’ property or service; (4) acting in an unsportsmanlike or disruptive manner, or with the intent to annoy, abuse, threaten or harass any other person. Any false information provided within the context of the School Garden Competition by any entrant concerning identity, postal address, ownership of rights or non-compliance with the Rules may result in the immediate disqualification of an entrant from the School Garden Competition. Jim Metzner Productions, Inc. further reserves the right to disqualify any entry that it believes in its sole and unfettered discretion, infringes upon any third party right, violates any law or otherwise does not comply with these Rules. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY PROPERTY OR UNDERMINE THE LEGITIMATE OPERATION OF THE SCHOOL GARDEN COMPETITION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, JIM METZNER PRODUCTIONS, INC. RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
  10. Selection of Winners. Entries will be determined by Jim Metzer Productions based on the number of eligible and accepted entries submitted to the Kids’ Science Challenge. The entrant who submits the most entries by the January 15, 2012 deadline is eligible to win Prize One. The entrant who submits the most entries by the February 29, 2012 deadline is eligible to win Prize Two. All entrants who submit five or more entries to the Kids’ Science Challenge by the February 29, 2012 will be entered into a random drawing and one of those entrants will win Prize Three.
    Decisions of Jim Metzner Productions are final and binding. In the event there are not enough eligible entries, not all prizes will be awarded. If a winner is not able for whatever reason to accept his or her prize, then Jim Metzner Productions, Inc. reserves the right to award the prize to another entrant or U.S. School or After School Program.
  11. Prizes. Each Winner will win a gift certificate redeemable by their school or after school program for a Naturalyards Garden (retail value approximately $3,500). Costs of shipping to the school is included in the prize award. Winners are responsible for incidentals or expenses in storing and installing the garden. There is no cash alternative and the prizes must be taken as offered. Jim Metzner Productions, Inc. reserves the right to substitute prize(s) of an equivalent value should the School Garden Competition prizes become unavailable for any reason, and/or to not award any prize whatsoever. In the event of a tie, the winners will be decided by a random drawing.
  12. Media Activity: By participating in this School Garden Competition, you agree to participate in any media or promotional activity regarding the School Garden Competition. You agree that Jim Metzner Productions may use your name and likeness to administer and promote the School Garden Competition and to conduct media interviews and promotional events.
  13. Privacy Notice. By participating in this School Garden Competition, you agree that Jim Metzner Productions, Inc. can collect your personal information, and that if Jim Metzner Productions, Inc. cannot collect the required data, you may not be eligible to participate in the School Garden Competition. Any personal information collected during the course of the School Garden Competition by Jim Metzner Productions, Inc. will only be used for administering this School Garden Competition and for other purposes as outlined in these Rules. You will have the right to access, review, rectify or cancel any personal data held by Jim Metzner Productions, Inc. by writing to Jim Metzner Productions, Inc. (Attention: Privacy Matters) at the Jim Metzner Productions, Inc. address listed above.
  14. General Conditions. This School Garden Competition is governed by the laws of the State of New York, United States. All federal, state and local laws and regulations apply. By participating in this School Garden Competition, you agree to be bound by the terms of these Rules and by Jim Metzner Productions, Inc.’s decisions, which are final and binding on all matters pertaining to this School Garden Competition. Return of any prize/prize notification may result in disqualification and selection of an alternate winner. Any potential winner who cannot be contacted within five (5) business days of attempted first notification will forfeit his or her prize. Potential prize winners may be required to sign, notarize, and return an affidavit or declaration of eligibility, a liability/publicity release, an I.R.S. Form W-9, within three (3) business days and provide any additional information that may be required by Jim Metzner Productions, Inc. Failure to comply within this time period may result in disqualification and selection of an alternate winner. Jim Metzner Productions, Inc. is not responsible for any typographical or other error in the printing of the offer, administration of the School Garden Competition or in the announcement of the prizes. Entrants certify that that they have the right to submit the submission in the School Garden Competition. Each entrant agrees not to participate in the School Garden Competition in any manner that might: (i) infringe any third-party proprietary, intellectual property, industrial property, personal rights or other rights, including without limitation, copyright, trademark, patent, trade secret or confidentiality obligation; or (2) otherwise violate applicable law in any countries in the world.
  15. No Recourse to Judicial or Other Procedures. To the extent permitted by law, the rights to litigate, to seek injunctive relief, or to any other recourse to judicial or any other procedure in case of disputes or claims resulting from or in connection with this School Garden School Garden Competition are hereby excluded, and you expressly waive any and all such rights.
  16. LIMITATIONS OF LIABILITY: TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU INDEMNIFY AND AGREE TO KEEP INDEMNIFIED JIM METZNER PRODUCTIONS, INC. AT ALL TIMES FROM AND AGAINST ANY LIABILITY, CLAIMS, DEMANDS, LOSSES, DAMAGES, COSTS AND EXPENSES RESULTING FROM ANY ACT, DEFAULT OR OMISSION BY YOU AND/OR A BREACH OF ANY WARRANTY BY YOU SET FORTH HEREIN. TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU INDEMNIFY AND AGREE TO KEEP INDEMNIFIED JIM METZNER PRODUCTIONS, INC. AT ALL TIMES FROM AND AGAINST ANY LIABILITY, ACTIONS, CLAIMS, DEMANDS, LOSSES, DAMAGES, COSTS AND EXPENSES FOR OR IN RESPECT OF WHICH JIM METZNER PRODUCTIONS, INC. WILL OR MAY BECOME LIABLE BY REASON OF OR RELATED OR INCIDENTAL TO ANY ACT, DEFAULT OR OMISSION BY YOU UNDER THESE RULES INCLUDING WITHOUT LIMITATION RESULTING FROM OR IN RELATION TO ANY BREACH, NON-OBSERVANCE, ACT OR OMISSION WHETHER NEGLIGENT OR OTHERWISE, PURSUANT TO THESE RULES BY YOU. TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AGREE TO HOLD JIM METZNER PRODUCTIONS, INC., ITS RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES AND ASSIGNS HARMLESS FOR ANY INJURY OR DAMAGE CAUSED OR CLAIMED TO BE CAUSED BY PARTICIPATION IN THE SCHOOL GARDEN COMPETITION AND/OR USE OR ACCEPTANCE OF ANY PRIZE WON.
  17. Third Parties. Jim Metzner Productions, Inc. is not responsible for the policies, actions, or inactions of others, including Entrant’s parents/legal guardian or representatives from U.S. Schools or After School Programs that might prevent the Entrant from entering, participating, and/or claiming a prize in this School Garden Competition.
  18. Intellectual Property. By registering for the School Garden Competition and/or submitting an entry you agree explicitly that all components of your artwork and supporting statement are indeed original creations. Any intellectual property infringement, misuse or plagarism of another’s work in any form or state will result in immediate disqualification and forfeiture of eligibility to receive all awards, recognition and prizes. You also agree to allow Jim Metzner Productions, Inc. to make public statements regarding any disqualifications and any grounds for disqualification. All intellectual property and industrial property rights in any entries that belonged to the Entrants will remain with the Entrants, but the submissions will otherwise become the property of Jim Metzner Productions, Inc., and will not be returned after the School Garden Competition. You grant Jim Metzner Productions, Inc. permission to use, copy, modify, distribute, and publicly display your School Garden Competition submission for any purpose, including display on the Jim Metzner Productions, Inc. website, without any attribution or compensation to you.
  19. Severability. If any provision(s) of these Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.
  20. Winner List. The names of the winners will be posted on the School Garden Competition Website within one (1) month of the end of the School Garden Competition.
